California Says: You Can’t Replace an Actor with AI (at Least Not Easily)

You Can’t Replace an Actor with AI - California made it illegal

California has just made a bold move. It’s now illegal to use artificial intelligence to replace a real actor, at least in certain scenarios. Governor Gavin Newsom signed two new laws—AB 2602 and AB 1836—that protect performers from being digitally cloned without their consent.

Here’s what these laws do:

  • AB 2602 says contracts that let studios use a “digital replica” of an actor’s voice or image—without full clarity or consent—can be considered invalid.

  • AB 1836 stops studios from creating or distributing AI versions of deceased actors unless their estates give permission.

Together, these laws are meant to stop the misuse of AI in entertainment, especially as deepfake technology becomes more convincing.

Gavin Newsom signed these bills on September 17, 2024, with support from SAG-AFTRA, the union representing actors and performers. He said the goal is simple: protect workers, while still allowing the creative industry to flourish. Critics, however, say the laws might be hard to enforce. What’s a “digital replica” exactly? How do you prove harm when AI is used in subtle ways? There are big questions left open…

Still, this is one of the first times a U.S. state has stepped in to restrict how AI can use human likeness in the entertainment world. It could set a precedent for other states and maybe even national laws someday.

The future of film, voice acting, and performance may no longer be just about flesh and blood—but laws like these remind us that behind every character, there’s a person whose rights matter.

And let’s be honest — many actors, artists, and creators around the world are quietly celebrating this decision. Finally, a step that protects the human touch in art.

Do you think this is the beginning of a fairer balance between technology and creativity?
